Als autorisierter Partner (Affiliate) von Pascal Philippe L. Dricot stimmst du zu, die in dieser Vereinbarung enthaltenen Bedingungen einzuhalten. Bitte lies die gesamte Vereinbarung sorgfältig durch, bevor du dich registrierst und Pascal Philippe L. Dricot als Affiliate bewirbst.
Deine Teilnahme am Programm dient nur dazu, unsere Website legal zu bewerben, um eine Provision für Mitgliedschaften und Produkte zu erhalten, die von Personen gekauft werden, die du über deine eigene Website oder persönliche Empfehlungen an Pascal Philippe L. Dricot verwiesen hast.
Mit deiner Anmeldung zum Affiliate-Programm von Pascal Philippe L. Dricot zeigst du deine Zustimmung zu dieser Vereinbarung und ihren Bedingungen.
1. Genehmigung oder Ablehnung des Antrags Wir behalten uns das Recht vor, JEDEN Affiliate-Programmantrag nach unserem alleinigen und absoluten Ermessen zu genehmigen oder abzulehnen. Du hast keinen rechtlichen Anspruch gegen uns bei Ablehnung deines Affiliate-Programmantrags.
2. Provisionen Provisionen werden einmal im Monat ausgezahlt. Damit ein Affiliate eine Provision erhält, muss das verwiesene Konto für mindestens 37 Tage aktiv bleiben.
Du kannst dich nicht selbst empfehlen und wirst keine Provision für deine eigenen Konten erhalten. Es gibt auch eine Begrenzung von einer Provision pro Empfehlung. Wenn jemand den Link auf deiner Website anklickt und mehrere Konten bestellt, erhältst du nur für die erste Bestellung eine Provision.
Zahlungen werden nur für erfolgreich abgeschlossene Transaktionen gesendet. Transaktionen, die zu Rückbuchungen oder Rückerstattungen führen, werden nicht ausgezahlt.
3. Beendigung Dein Affiliate-Antrag und dein Status im Programm können aus folgenden Gründen ausgesetzt oder beendet werden:
• Unangemessene Werbung (falsche Behauptungen, irreführende Hyperlinks usw.).
• Spamming (Massen-E-Mails, Massen-Posting in Newsgroups usw.).
• Werbung auf Websites, die illegale Aktivitäten enthalten oder fördern.
• Versäumnis, die Affiliate-Beziehung für jede Werbung offenzulegen, die als Empfehlung gemäß den geltenden Richtlinien und Vorschriften der Federal Trade Commission oder geltenden Landesgesetzen gilt.
• Verletzung von geistigen Eigentumsrechten. Pascal Philippe L. Dricot behält sich das Recht vor, Lizenzvereinbarungen von denen zu verlangen, die Markenzeichen von Pascal Philippe L. Dricot verwenden, um unsere geistigen Eigentumsrechte zu schützen.
• Angebot von Rabatten, Gutscheinen oder anderen Formen von versprochenen Kickbacks aus deiner Affiliate-Provision als Anreiz. Das Hinzufügen von Boni oder das Bündeln anderer Produkte mit Pascal Philippe L. Dricot ist jedoch akzeptabel.
• Selbstempfehlungen, betrügerische Transaktionen, mutmaßlicher Affiliate-Betrug.
Neben den oben genannten Gründen behält sich Pascal Philippe L. Dricot das Recht vor, jedes Affiliate-Konto jederzeit aus beliebigen Gründen oder ohne Grund zu kündigen.
4. Affiliate-Links Du darfst grafische und Textlinks sowohl auf deiner Website als auch in deinen E-Mail-Nachrichten verwenden. Du darfst die Pascal Philippe L. Dricot-Website auch in Online- und Offline-Kleinanzeigen, Zeitschriften und Zeitungen bewerben.
Du kannst die von uns bereitgestellten Grafiken und Texte verwenden oder deine eigenen erstellen, solange sie als angemessen gelten und nicht gegen Bedingung 3 verstoßen.
5. Gutschein- und Deal-Websites Pascal Philippe L. Dricot bietet gelegentlich Gutscheine für ausgewählte Affiliates und unsere Newsletter-Abonnenten an. Wenn du nicht vorab genehmigt oder einem Markengutschein zugewiesen wurdest, darfst du den Gutschein nicht bewerben. Nachfolgend sind die Bedingungen aufgeführt, die für jeden Affiliate gelten, der die Bewerbung unserer Produkte im Zusammenhang mit einem Angebot oder Gutschein in Erwägung zieht:
• Affiliates dürfen keinen irreführenden Text auf Affiliate-Links, -Tasten oder -Bildern verwenden, um den Eindruck zu erwecken, dass außer den derzeit autorisierten Angeboten für den jeweiligen Affiliate etwas verfügbar ist.
• Affiliates dürfen nicht auf Pascal Philippe L. Dricot-Gutscheine, Pascal Philippe L. Dricot-Rabatte oder andere Phrasen bieten, die darauf hindeuten, dass Gutscheine verfügbar sind.
• Affiliates dürfen keine Pop-ups, Pop-unders, iframes, Frames oder andere sichtbare oder unsichtbare Aktionen erzeugen, die Affiliate-Cookies setzen, es sei denn, der Benutzer hat ein klares und ausdrückliches Interesse an der Aktivierung einer bestimmten Ersparnis durch Klicken auf einen deutlich gekennzeichneten Link, eine Schaltfläche oder ein Bild für diesen speziellen Gutschein oder dieses spezielle Angebot gezeigt. Dein Link muss den Besucher zur Händlerseite senden.
• Der Benutzer muss in der Lage sein, Informationen und Details zu Gutscheinen/Angeboten/Ersparnissen zu sehen, bevor ein Affiliate-Cookie gesetzt wird (d. h. "Klicken Sie hier, um Gutscheine zu sehen und ein Fenster zur Händlerseite zu öffnen" ist NICHT erlaubt).
• Affiliate-Websites dürfen nicht "Klicken für (oder um zu sehen) Deal/Gutschein" oder eine Variation haben, wenn keine Gutscheine oder Angebote verfügbar sind, und der Klick öffnet die Händlerseite oder setzt ein Cookie. Affiliates mit solchem Text auf der Händler-Landingpage werden sofort aus dem Programm entfernt.
6. Pay-per-Click (PPC)-Richtlinie PPC-Gebote sind NICHT erlaubt, ohne vorherige schriftliche Genehmigung.
7. Haftung Pascal Philippe L. Dricot haftet nicht für indirekte oder zufällige Schäden (Einnahmeverluste, Provisionen) aufgrund von Affiliate-Tracking-Fehlern, Datenbankverlusten oder jeglichen Absichten, dem Programm und/oder unseren Website(s) zu schaden.
Wir geben keine ausdrücklichen oder stillschweigenden Garantien in Bezug auf das Programm und/oder die von Pascal Philippe L. Dricot verkauften Mitgliedschaften oder Produkte ab. Wir behaupten nicht, dass der Betrieb des Programms und/oder unserer Website(s) fehlerfrei sein wird, und wir haften nicht für Unterbrechungen oder Fehler.
8. Laufzeit der Vereinbarung Die Laufzeit dieser Vereinbarung beginnt mit deiner Annahme im Programm und endet, wenn dein Affiliate-Konto gekündigt wird.
Die Bedingungen dieser Vereinbarung können von uns jederzeit geändert werden. Wenn eine Änderung der Bedingungen dieser Vereinbarung für dich nicht akzeptabel ist, ist deine einzige Möglichkeit, dein Affiliate-Konto zu kündigen. Deine fortgesetzte Teilnahme am Programm bedeutet deine Annahme einer Änderung.
9. Schadenersatz Der Affiliate hat Pascal Philippe L. Dricot und seine verbundenen und Tochterunternehmen, leitende Angestellte, Direktoren, Mitarbeiter, Lizenznehmer, Rechtsnachfolger und Abtretungsempfänger, einschließlich derjenigen, die von Pascal Philippe L. Dricot lizenziert oder autorisiert sind, Materialien zu übertragen und zu verteilen, von allen Haftungen, Schäden, Geldstrafen, Urteilen, Ansprüchen, Kosten, Verlusten und Ausgaben (einschließlich angemessener Anwaltskosten und -kosten) freizustellen und schadlos zu halten, die im Zusammenhang mit dieser Vereinbarung aufgrund von Fahrlässigkeit, Falschdarstellung, Versäumnis der Offenlegung oder vorsätzlichem Fehlverhalten des Affiliates entstehen.
10. Anwendbares Recht, Gerichtsstand und Anwaltskosten Diese Vereinbarung unterliegt dem Recht Österreichs und wird in Übereinstimmung damit ausgelegt. Jeder Streit, der im Zusammenhang mit dieser Vereinbarung entsteht, wird ausschließlich vor den staatlichen Gerichten in Wien, Österreich, verhandelt.
Im Falle eines Rechtsstreits zur Durchsetzung einer Bestimmung dieser Vereinbarung hat die obsiegende Partei Anspruch auf Erstattung ihrer Kosten und Gebühren, einschließlich angemessener Anwaltskosten.
11. Elektronische Signaturen wirksam Die Vereinbarung ist ein elektronischer Vertrag, der die rechtlich bindenden Bedingungen für deine Teilnahme am Affiliate-Programm von Pascal Philippe L. Dricot festlegt. Durch Abschluss des Antragsprozesses für Pascal Philippe L. Dricot zeigst du deine Annahme dieser Vereinbarung und aller darin enthaltenen oder darauf verwiesenen Bedingungen an. Diese Aktion erzeugt eine elektronische Unterschrift, die die gleiche rechtliche Kraft und Wirkung wie eine handschriftliche Unterschrift hat.
As an authorized affiliate (Affiliate) of Pascal Philippe L. Dricot (Pascal Philippe L. Dricot), you agree to abide by the terms and conditions contained in this Agreement (Agreement). Please read the entire Agreement carefully before registering and promoting Pascal Philippe L. Dricot as an Affiliate.
Your participation in the Program is solely to legally advertise our website to receive a commission on memberships and products purchased by individuals referred to Pascal Philippe L. Dricot by your own website or personal referrals.
By signing up for the Pascal Philippe L. Dricot Affiliate Program (Program), you indicate your acceptance of this Agreement and its terms and conditions.
1. Approval or Rejection of the Application
We reserve the right to approve or reject ANY Affiliate Program Application in our sole and absolute discretion. You will have no legal recourse against us for the rejection of your Affiliate Program Application.
2. Commissions
Commissions will be paid once a month. For an Affiliate to receive a commission, the referred account must remain active for a minimum of 37 days.
You cannot refer yourself, and you will not receive a commission on your own accounts. There is also a limit of one commission per referral. If someone clicks the link on your site and orders multiple accounts, then you will receive a commission on the first order only.
Payments will only be sent for transactions that have been successfully completed. Transactions that result in chargebacks or refunds will not be paid out.
3. Termination
Your affiliate application and status in the Program may be suspended or terminated for any of the following reasons:
Inappropriate advertisements (false claims, misleading hyperlinks, etc.).
Spamming (mass email, mass newsgroup posting, etc.).
Advertising on sites containing or promoting illegal activities.
Failure to disclose the affiliate relationship for any promotion that qualifies as an endorsement under existing Federal Trade Commission guidelines and regulations, or any applicable state laws.
Violation of intellectual property rights. Pascal Philippe L. Dricot reserves the right to require license agreements from those who employ trademarks of Pascal Philippe L. Dricot in order to protect our intellectual property rights.
Offering rebates, coupons, or other form of promised kick-backs from your affiliate commission as an incentive. Adding bonuses or bundling other products with Pascal Philippe L. Dricot, however, is acceptable.
Self referrals, fraudulent transactions, suspected Affiliate fraud.
In addition to the foregoing, Pascal Philippe L. Dricot reserves the right to terminate any Affiliate account at any time, for any violations of this Agreement or no reason.
4. Affiliate Links
You may use graphic and text links both on your website and within in your email messages. You may also advertise the Pascal Philippe L. Dricot site in online and offline classified ads, magazines, and newspapers.
You may use the graphics and text provided by us, or you may create your own as long as they are deemed appropriate according to the conditions and not in violation as outlined in Condition 3.
5. Coupon and Deal Sites
Pascal Philippe L. Dricot occasionally offers coupons to select affiliates and to our newsletter subscribers. If you’re not pre-approved / assigned a branded coupon, then you’re not allowed to promote the coupon. Below are the terms that apply for any affiliate who is considering the promotion of our products in relation to a deal or coupon:
Affiliates may not use misleading text on affiliate links, buttons or images to imply that anything besides currently authorized deals to the specific affiliate.
Affiliates may not bid on Pascal Philippe L. Dricot Coupons, Pascal Philippe L. Dricot Discounts or other phrases implying coupons are available.
Affiliates may not generate pop-ups, pop-unders, iframes, frames, or any other seen or unseen actions that set affiliate cookies unless the user has expressed a clear and explicit interest in activating a specific savings by clicking on a clearly marked link, button or image for that particular coupon or deal. Your link must send the visitor to the merchant site.
User must be able to see coupon/deal/savings information and details before an affiliate cookie is set (i.e. “click here to see coupons and open a window to merchant site” is NOT allowed).
Affiliate sites may not have “Click for (or to see) Deal/Coupon” or any variation, when there are no coupons or deals available, and the click opens the merchant site or sets a cookie. Affiliates with such text on the merchant landing page will be removed from the program immediately.
6. Pay Per Click (PPC) Policy
PPC bidding is NOT allowed without prior written permission.
7. Liability
Pascal Philippe L. Dricot will not be liable for indirect or accidental damages (loss of revenue, commissions) due to affiliate tracking failures, loss of database files, or any results of intents of harm to the Program and/or to our website(s).
We do not make any expressed or implied warranties with respect to the Program and/or the memberships or products sold by Pascal Philippe L. Dricot. We make no claim that the operation of the Program and/or our website(s) will be error-free and we will not be liable for any interruptions or errors.
8. Term of the Agreement
The term of this Agreement begins upon your acceptance in the Program and will end when your Affiliate account is terminated.
The terms and conditions of this agreement may be modified by us at any time. If any modification to the terms and conditions of this Agreement are unacceptable to you, your only choice is to terminate your Affiliate account. Your continuing participation in the Program will constitute your acceptance of any change.
9. Indemnification
Affiliate shall indemnify and hold harmless Pascal Philippe L. Dricot and its affiliate and subsidiary companies, officers, directors, employees, licensees, successors and assigns, including those licensed or authorized by Pascal Philippe L. Dricot to transmit and distribute materials, from any and all liabilities, damages, fines, judgments, claims, costs, losses, and expenses (including reasonable legal fees and costs) arising out of or related to any and all claims sustained in connection with this Agreement due to the negligence, misrepresentation, failure to disclose, or intentional misconduct of Affiliate.
10. Governing Law, Jurisdiction, and Attorney Fees
This Agreement shall be governed by and construed in accordance with the laws of Austria. Any dispute arising under or related in any way to this Agreement shall be adjudicated exclusively in the state courts located in Vienna, Austria.
In the event of litigation to enforce any provision of this Agreement, the prevailing party will be entitled to recover from the other party its costs and fees, including reasonable legal fees.
11. Electronic Signatures Effective
The Agreement is an electronic contract that sets out the legally binding terms of your participation in the Pascal Philippe L. Dricot affiliate program. You indicate your acceptance of this Agreement and all of the terms and conditions contained or referenced in this Agreement by completing the Pascal Philippe L. Dricot application process. This action creates an electronic signature that has the same legal force and effect as a handwritten signature.
